1. Welcoming Travelers
As a Host on bookstmartin.com, you have the right to use our platform to share your accommodations with our community of travelers. You are free to create your listing, set your prices, availability, and rules.
2. Contract with Travelers
By accepting a reservation request on bookstmartin.com, you enter into a direct contract with the traveler. You are responsible for providing the accommodation service exactly as described in your listing, adhering to the pricing conditions you have set. Service fees for bookstmartin.com, as specified when posting your listing, will be deducted from your payments.
You may establish an additional rental agreement with the traveler, provided it does not contradict the terms of your listing or these Terms of Service. Your obligations to bookstmartin.com remain unchanged, even with a separate contract.
3. Managing Your Listing
Your listing must provide accurate and complete information about your offering, including price and any additional fees. You are responsible for updating and maintaining the accuracy of your listing. You must provide us with an iCal link to synchronize reservation calendars.
4. Legal Obligations
As a Host, you must be aware of and comply with all laws, regulations, and third-party contracts applicable to your hosting service, such as subletting restrictions or local regulations.
5. Your Responsibilities
You are responsible for your actions and omissions, as well as those of individuals involved in providing your services. You must clearly list all fees in your listing and may not charge additional fees outside the platform, except with explicit permission from us.
6. Cancellations and Reservation Modifications
Cancellation policies for travelers are as follows:
– More than 30 days before the stay: Free cancellation
– Less than 30 days before the stay: No refund.
To ensure optimal service to our clients, we strongly advise you to keep your calendars up to date to avoid having to refuse requests or cancel reservations. We reserve the right to delete the accounts of owners who refuse or cancel reservations, except in cases of force majeure.
As a Host on bookstmartin.com, you are fully responsible for managing the taxes applicable to your services. This includes declaring, collecting, remitting, or including in your price all necessary taxes. Specifically, you must collect and remit the Transaction Tax (TGCA) and the Lodging Tax (TOT) for accommodations located on the Dutch side of the island.
It is important to note that bookstmartin.com does not participate in the collection or remittance of these taxes. As a Host, it is your duty to ensure that all tax obligations are met in accordance with local regulations.
This tax responsibility is an integral part of your role as a Host and is essential for maintaining legal compliance on the bookstmartin.com platform.
The content you provide on the platform, including comments and photos, is your responsibility. You are accountable for respecting intellectual property rights and privacy.
9. Platform Regulations
You must act with integrity and respect towards other users, and comply with applicable laws. Any booking or payment outside the platform is prohibited. Messages are monitored to prevent any off-platform negotiations.
10. Termination and Suspension
Your contract with bookstmartin.com remains in effect until termination. We may suspend or terminate your account in case of a breach of these terms or applicable laws.
11. Modifications to Terms
Any changes to these terms will be communicated and, except in the case of minor changes or those imposed by law, your agreement will be required.
