1.1 These Terms of Service (“Terms”) govern access to and use of the website www.bookstmartin.com (the “Site”), operated by Digital Madame LLC, a Wyoming Limited Liability Company.
1.2 By accessing or using the Site, you agree to these Terms. Use of the Site is permitted only for individuals aged 18 or older, capable of entering into legally binding agreements.
2.1 BookStMartin is a visibility and connection platform. Property owners and local businesses (“Hosts”) may publish listings, and travelers or visitors (“Guests”) may contact them directly.
2.2 BookStMartin is not a party to any rental, service, or commercial contract entered into between Hosts and Guests.
2.3 BookStMartin does not manage reservations, payments, or cancellations, and does not guarantee the quality, accuracy, or availability of listings.
2.4 The contractual relationship exists solely between Host and Guest.
3.1 Hosts are solely responsible for:
The accuracy of their listings (descriptions, availability, prices, photos).
Compliance with local laws, regulations, licenses, permits, and tax obligations.
Managing all inquiries, bookings, payments, and cancellations directly with Guests.
3.2 Hosts agree to indemnify and hold harmless BookStMartin from any claims, damages, liabilities, or disputes arising from their listings, their conduct, or their contractual relationships with Guests.
4.1 Guests understand that all bookings, payments, and cancellations are made directly with the Host.
4.2 Guests are responsible for verifying the reliability of the Host and for complying with the Host’s terms, house rules, and all applicable laws.
4.3 BookStMartin cannot be held liable for cancellations, overbookings, disputes, damages, injuries, or losses arising from stays, services, or experiences booked via the Site.
5.1 To the maximum extent permitted by law, BookStMartin, its owners, employees, and partners disclaim all liability for:
Errors, omissions, or inaccuracies in listings.
Any cancellations, changes, or disputes between Hosts and Guests.
Any loss, damage, injury, or claim related to accommodations, services, or experiences advertised on the Site.
5.2 BookStMartin’s role is limited to providing online visibility and marketing support. Users acknowledge and accept that all risks related to bookings or services rest entirely with the Host and Guest.
6.1 Any dispute regarding a booking, payment, or rental/service contract must be resolved exclusively between Host and Guest.
6.2 In the event of a dispute involving BookStMartin, the user agrees to first seek amicable resolution before any legal proceedings.
The processing of personal data is governed by our Privacy Policy, available separately on the Site.
BookStMartin may amend these Terms at any time. Updated Terms will be published on the Site, and continued use of the Site constitutes acceptance of the revised Terms.
